Hello My name is Joseph A Guagliardo, When
I was on the job. It was Joseph A Gagliardo or Joe Gag.
After retiring in 1989, there was a merge
or take over all depending on who you ask. Of the NYC Police, Transit and
Housing Police Departments.
In the early 90's after the merge a man
named Edward Ranieri and I, embarked on what is an endless task of not only
fighting for the VSF/ DEFINED COMP for all who paid into the pension (
police ) We sought legislation. Retiree groups were split based on the
retirees who were receiving the benefit and those who did not. The Unions
were split this included the Corrections and FDNY on who should get it. For
some reason any job after NYPD who obtained the additional pension fund did
it the same as NYPD Excluding Disabled retirees, as well as pre 1968, and
vested.
NYPD's lawsuit was brought so long after
the actual VSF became law, but when the merge occurred an opening existed
for Housing and Transit Retirees. and so became Gagliardo v. Dinkins and
Ranieri V Dinkins et. al
In addition to the lawsuit we went to
albany and not only sought an amendment to the bill allowing retirees
discriminated against but we sought a simple "inquiry bill" this would have
caused the legislature to read the law and examine if that was the intent (
excluding disabled and others excluded from the VSF.
